Marine Family Doxxed, Threatened After Lawsuit Error

The family of a U.S. Marine has been subjected to doxxing, threats, and harassment after attorneys for a plaintiff in a Cornell University civil lawsuit mistakenly used the Marine's address instead of that of a former fraternity member with the same name.

Attorney Elliot Hallak informed New York Judge Phaedra Perry-Bond that the filing containing his client's address should be removed from the public record to mitigate the consequences for his client and family. Doe's legal team has since filed an amended document with the correct address, but the initial filing remained accessible, exposing the Marine's family.

Hallak stated that his client, who has no connection to Cornell University, was stationed in North Carolina during the alleged sexual assault in October 2024 that is central to the lawsuit. Despite this, after the incorrect address was listed, the family received death threats and had their phone numbers published online.

The lawsuit, filed by Jane Doe, alleges sexual assault by seven former members of the Chi Phi fraternity between Oct. 19 and Oct. 20, 2024, at the fraternity's house. Doe also claims she was pressured into snorting ketamine. The university suspended the fraternity and disciplined some students, but no criminal charges have been filed.

Doe's allegations have previously led to protests and vandalism at Cornell, including graffiti on campus buildings. At least one other individual with the same name as a defendant has also reported harassment.

In addition to naming seven former Chi Phi members, the lawsuit also includes Cornell University, Doe's sorority, and Moonies Bar and Nightclub, where Doe alleges she was served alcohol while underage. Moonies Bar and Nightclub has requested a change of venue for the case from New York City to Tompkins County.

New York Governor Kathy Hochul has directed Attorney General Letitia James to open an investigation into the matter.
