Man Sentenced to 18 Years for Killing Pensioner During Home Burglary

A man has been sentenced to 18 years in prison for the manslaughter of an 86-year-old pensioner who died after being headbutted during a burglary. Ashley Malcolm, 40, received the sentence, along with a further five years on extended license, at the Old Bailey after pleading guilty to the killing of John Burke.

Malcolm attacked Mr. Burke during a burglary at the home the pensioner shared with his 91-year-old wife, Peggy, on Fountayne Road in Hackney, east London. The incident occurred in the early hours of September 29, 2025. Mr. Burke died the day after the attack.

Sentencing Malcolm, Judge Simon Mayo KC stated that the defendant had "embarked on a sustained course of criminal conduct" throughout the night of September 28 and 29, 2025, which included breaking into "several" residential properties. The judge noted that Malcolm entered the home of "two elderly and vulnerable occupants" and that the burglary took place over a prolonged period.

"During the course of that burglary you headbutted Mr. Burke," the judge said. "That headbutt fractured his nose and caused intercranial bleeding, and he died as a consequence." Judge Mayo acknowledged the "immeasurable" loss experienced by Mr. Burke's family, including his widow, to whom he had been married for many decades.

Within hours of burglarizing the elderly couple's home, Malcolm reportedly broke into a care home and attempted to burgle another flat while its occupants were present. Court documents revealed that Mr. Burke had been in poor health and suffered from several conditions, including dementia, at the time of the attack. Malcolm is from Hackney.
