James Andrew has been sentenced for an animal welfare offense after he was filmed grabbing a terrier by the head and throwing it over a fence. The incident, which occurred on September 5 of last year, was captured by neighbors who subsequently alerted the police and the RSPCA.
The RSPCA found the dog, named Boomer, in poor condition, exhibiting crust around his eyes, scabs on his ears, and being underweight. Further investigation at the couple's home revealed multiple animals living in crates without bedding in the kitchen, and the garden was covered in rubbish and feces. A solicitor representing the RSPCA described the house as being in a "disgusting state."
Andrew admitted to handling his partner's dog inappropriately, stating he had experience with dogs in a similar manner from his work with the military police. However, it was noted by the court that Boomer was a "tiny terrier" and not a military working dog.
Boomer, who was eventually removed from the pair and rehomed, gained weight significantly in under a month. Andrew and his partner, Claire Yvonne Malik, both pleaded guilty to an animal welfare offense. Andrew also faced a second charge for failing to protect an animal from pain, suffering, or injury.
Representatives for the defense argued that the incident was isolated and that the couple had since cleaned their home. It was stated that Malik had not witnessed Andrew's actions until viewing the video in court, at which point she was reportedly appalled. The couple, who share five children and do not work, are no longer in a relationship but continue to reside at the same address. They no longer own any animals.
Bristol Magistrates' Court ordered Malik to pay a £568 fine and disqualified her from keeping dogs for five years. Andrew was fined £680 and disqualified from keeping any animals for 10 years. He reportedly smiled as he left the court.
