Claire Kellerman, the daughter of the late MAS*H star Sally Kellerman, is utilizing Scottish taxpayer funds to pursue a legal challenge against an Outer Hebrides charity over its policy on service dogs in a cafe. Kellerman, 62, claims the volunteer-run cafe operated by the Bernera Community Association denied entry to her disability service dog.

The dispute has been ongoing for a year. Initially, Kellerman's legal action was directed at the Bernera Community Development Trust. However, after incurring £7,000 in legal costs, her lawyers discovered they had sued the incorrect organization, which had no affiliation with the cafe. Due to her using Scottish Legal Aid, Kellerman was not personally responsible for these initial costs.

Subsequently, her legal team filed an amended claim for £10,000 against the Bernera Community Association, the actual operators of the cafe, through Glasgow's publicly funded Ethnic Minorities Law Centre. The charity, which relies on fundraising, has stated that further legal costs could lead to bankruptcy.

A hearing took place last week at Stornoway Sheriff Court, with legal arguments scheduled for December.

Kellerman, who moved to the Isle of Great Bernera approximately four years ago, described the situation in a LinkedIn post as an opportunity to expose the "normalization of abuses on the Isle of Bernera, in the Bernera Community Cafe." She detailed these alleged abuses as including "exclusion, collective harassment, shaming, ostracization, wrongful blaming, illegal discrimination and victimization" by the association's directors and members. She characterized the environment for disabled individuals with assistance dogs as "vile" and marked by "intentional, targeted hostility" stemming from "ignorance, and unwillingness to welcome all equally."

She expressed a desire for the legal action to bring "justice" and "spiritual growth" to the charity members, enhancing their ability to understand and cease alleged violations of the Equality and Human Rights Act of 2010.

Scottish politicians have raised concerns about the funding. Labour MSP Donald Mackinnon has requested an urgent review of the case's funding by the Scottish Legal Aid Board, citing potential reputational damage. Murdo Fraser, a Conservative MSP, described the situation as "absolutely appalling" and questioned why taxpayer money is financing the legal bills for a complainant who reportedly possesses significant assets.
