Lindsay Clancy's Lawyer Seeks Investigation into Holdout Juror
Defense attorney claims juror may have provided inaccurate information during selection and used a cellphone during deliberations.
Lindsay Clancy's defense attorney is requesting a judge investigate a holdout juror in her mistrial case, alleging the juror may have inaccurately completed jury forms or provided false answers during the selection process. The motion, filed by attorney Kevin Reddington, also asks for an investigation into juror Michael Desronvil's alleged history of domestic violence and his use of a cellphone during deliberations.
Judge William Sullivan has agreed to impound jury information and questionnaires submitted before the trial but has not yet ruled on Reddington's motion. Desronvil was the sole juror who voted to find Clancy guilty of murdering her three children, while the other 11 jurors favored a not guilty verdict, citing postpartum psychosis.
Clancy is accused of strangling her children, 8-month-old Callan, 5-year-old Cora, and 3-year-old Dawson, on January 24, 2023. Her then-husband, Patrick Clancy, was out running errands at the time. Clancy subsequently attempted suicide and was left paralyzed, appearing in court in a wheelchair throughout her six-week trial.
Clancy is scheduled to return to Plymouth Superior Court in Massachusetts on September 29. On that date, Reddington is expected to seek the dismissal of charges, arguing that reasonable doubt regarding the prosecution's case was established, even by the holdout juror. Plymouth County District Attorney Tim Cruz is also anticipated to announce on September 29 whether a retrial will be pursued for Clancy.
In a recent interview, Patrick Clancy stated his belief that his ex-wife was suffering from postpartum psychosis when the killings occurred.
