A leaked court filing alleges that there was a plot to kill Noah Presgrove, a 19-year-old from Oklahoma, on the night his body was discovered last September. Presgrove was found naked by the side of U.S. 81 near Terral, Oklahoma, on September 4, 2023, hours after attending a birthday party about a mile away.
The first amended complaint, which has not yet been made public, reportedly contains new claims about the events leading up to Presgrove's death. According to the leaked document, obtained by the Daily Mail, Presgrove's death was not accidental but the result of an alleged murder plot.
Presgrove, a high school football player who graduated in May 2023, was reportedly last seen alive in a video posted at 1:42 a.m. on September 4, 2023. In the video, he appeared to be daring Brylan Sweat to slap him across the face while partying under an outdoor patio at a house. At 3:41 a.m. that same morning, Jasmine Millan posted a selfie to Snapchat with the caption, "well, Noah's missing."
The lawsuit names Jack Newton, 20, and his fiancée, Carter Combs, 21, as defendants, along with Avery Jo Combs, who allegedly hosted the party celebrating her 22nd birthday. The amended complaint accuses Avery Jo Combs of making statements about harming or killing Presgrove the morning before his death.
Presgrove's body was discovered wearing only tennis shoes. Police chalk outlines marked where his body and at least one of his teeth were found on the desolate stretch of highway. The lawsuit claims Newton and Carter Combs were responsible for his death, alleging they conspired to kill him and dispose of his body. Carter Combs, Avery's sister, was also named in the lawsuit as a party host.
Newton and Carter Combs have since welcomed a baby together after announcing they were expecting in March of the previous year. The lawsuit, filed by Presgrove's parents, Victor and Kasey Presgrove, alleges wrongful death and seeks damages.
