Former NFL player Kroy Biermann was photographed on Saturday for the first time since his eldest son, Kroy “KJ” Jagger Biermann Jr., was arrested on charges of aggravated sodomy and aggravated sexual battery. Biermann was seen picking up his 14-year-old son, Kash, from football practice in Alpharetta, Georgia.

Kroy Biermann, 40, appeared to be engrossed in his phone during the outing, dressed casually in a white T-shirt, black jeans, and black shoes. He carried his younger son’s football pads as they left the practice facility.

Kroy’s public appearance occurred nearly a week after his 15-year-old son, KJ, was taken into custody. According to court documents, a female classmate accused KJ of assaulting her on April 23 at the Life Time fitness center in Alpharetta. The accuser, who was 15 at the time of the alleged incident and identified herself as a friend of KJ’s girlfriend, claimed that KJ forced himself on her in a co-ed sauna despite her objections. The court documents state she alleged that KJ attempted to pull down her pants, force oral sex, and digitally penetrate her vagina before she was able to escape.

The court documents noted that KJ was visible on security camera footage at the gym on the day of the alleged assault, though he did not check in. A medical examination at North Fulton Hospital in Georgia on April 24 found no evidence of male DNA in the accuser's mouth or vagina, according to the police report. An investigation into the incident has been launched by the Alpharetta Police Department.

KJ's attorney, Jason Sheffield, stated that his client is “100% innocent” and that evidence, including a polygraph test administered by a respected polygrapher, was presented to the arresting officer. Sheffield also claimed the existence of evidence related to “other prior false allegations by the alleged victim.” He pointed to the lack of male DNA found during the examination as noted in the officer’s report, calling the arrest and being held without bond a “tragedy.”

“He is not only presumed innocent, but is, in fact, innocent,” Sheffield said in a statement. “I’m asking the public not to presume the truth of these allegations and to give the families on both sides their space and privacy.”

Kim Zolciak, KJ’s mother, also issued a statement calling the allegations “reckless and deeply troubling.” She asserted that her son “categorically denies ever being involved with this woman or engaging in the conduct she has alleged.” Zolciak added that KJ voluntarily took and passed a polygraph examination concerning the allegations, and that no DNA belonging to her son was found. She also raised concerns about the accuser allegedly making similar claims against two other individuals.

KJ is currently being held without bond, with his next court hearing scheduled for September 1. This story contains graphic details. If you or someone you know is affected by issues related to sexual assault, the Sexual Assault Hotline is available at 1-800-330-0226.
