KJ Biermann's Cellphone Conflict Detailed Amid Sexual Assault Charges
Court documents reveal parents Kim Zolciak and Kroy Biermann disputed possession of their son's phone more than a year before his arrest.
A dispute over KJ Biermann’s cellphone between his parents, Kim Zolciak and Kroy Biermann, occurred more than a year before prosecutors allege disturbing videos were found on the teen’s device in connection with his sexual assault case. The conflict over the phone emerged in court filings as part of the couple’s contentious divorce proceedings.
In February 2025, Zolciak, in a motion for an emergency hearing in Fulton County, claimed her estranged husband had taken possession of their children’s cellphones and restricted her access to them. This action followed a discovery by Kroy Biermann that remains redacted in public documents. On the same day, Zolciak filed a separate, heavily redacted motion for an in-camera inspection, a private review of evidence by a judge.
A subsequent filing in Cobb County, Georgia, where the divorce case was moved, referenced an order concerning the inspection of their "eldest child’s cellular telephone, and the data thereon." The couple share four children: KJ, 15, Kane, 14, and twins Kash and Kaia, 12.
Zolciak’s emergency hearing motion stated that on Feb. 7, 2025, Kroy informed a court-appointed mental health professional about a discovery that was also redacted from the filing. The motion further alleged that Kroy "began battening down the hatches," unilaterally restricting Zolciak’s parenting time with all children, confiscating their phones, and forbidding the children from communicating with her. Zolciak expressed grave concerns for the children's safety and well-being, as well as the preservation of evidence.
The couple initially filed a joint statement of dismissal for divorce proceedings in Fulton County before refiling in Cobb County. They agreed that their attorneys would seek an order governing the handling and inspection of KJ’s phone. In March 2025, the court ordered documents related to the matter to be sealed, and no public record of the inspection's results is available.
KJ was indicted in September 2026 by a Georgia grand jury on seven charges, including aggravated child molestation, aggravated sodomy, aggravated sexual battery, and false imprisonment. The charges stem from alleged acts against a victim under the age of 16 on April 23, 2026, at a Life Time Fitness in Alpharetta, Georgia. He has been held at Atlanta’s Metro Regional Youth Detention Center since his Aug. 17, 2026, arrest.
KJ’s lawyer, Jason Sheffield, has denied the claims, stating the teen "is not only presumed innocent, but is, in fact, innocent." Zolciak has also maintained her son’s innocence, calling the allegations "reckless and deeply troubling." Kroy Biermann has not publicly commented on the allegations.
During KJ's first court appearance on Sept. 13, 2026, prosecutors alleged that videos were found on his phone depicting him having sex with an underage family member. A judge granted KJ $200,000 bond. His release included conditions such as residing at his mother’s home, attending school virtually, abstaining from social media and cellphone use, avoiding contact with the alleged victim and anyone 16 or younger, and subject to electronic monitoring. Sheffield stated that the matter involved "inappropriate, crude behavior involving two middle-schoolers" and did not result in an adjudication for statutory rape or comparable offenses.
