A scheduled court hearing for Kroy "KJ" Biermann Jr., the 15-year-old son of reality television personality Kim Zolciak, was abruptly canceled Tuesday. Biermann Jr. is currently held at Atlanta's Metro Regional Youth Detention Center following his indictment on seven felony charges related to an alleged sexual assault.
His attorney, Jason Sheffield, confirmed that the recent indictment filed by the state has become the primary legal action, necessitating a change in judges and postponing the preliminary hearing. The charges include aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. These accusations stem from an alleged incident with a female classmate at a Life Time fitness center in Alpharetta, Georgia, on April 23.
Sheffield stated that the defense anticipates entering not guilty pleas to all charges at an arraignment hearing scheduled for October 14. He also plans to file a motion to transfer the case from adult court to juvenile court, arguing for Biermann Jr. to be tried as a juvenile. A bond hearing has been set for Friday, September 11.
Biermann Jr. was arrested on August 17 and has been in detention since. His attorney has expressed concern over the length of time the teenager has been held, attributing it to the severity of the charges and the legal constraints that followed.
According to court documents, the alleged victim stated the incident occurred in a family changing room at the fitness center. She reported that Biermann Jr. touched her, despite her protests, and then forced her to perform oral sex, also attempting sexual intercourse. Zolciak has vehemently denied the allegations, stating her son passed a polygraph examination and that no DNA evidence belonging to him was found.
Legal experts suggest that if convicted, the teen could face decades in prison. The decision to keep him in custody, rather than releasing him to his parents with monitoring, signals the seriousness of the case, one expert noted. Zolciak and her estranged husband, Kroy Biermann Sr., a former NFL player, are in the midst of a contentious divorce, with custody of their four minor children being a central issue. A judge previously granted Biermann Sr. primary physical custody.
