Kroy "KJ" Biermann Jr., the 15-year-old son of reality television personality Kim Zolciak, has filed a motion to have his felony sexual assault case transferred from adult court to juvenile court. The legal maneuver, filed Tuesday in Fulton County Court, seeks to move the proceedings to Georgia's juvenile justice system, where penalties are typically less severe.
KJ's legal team intends to enter a not guilty plea to all charges at an arraignment hearing scheduled for October 14. His attorney, Jason Sheffield, stated that the motion to transfer to juvenile court is aimed at ensuring his client is "tried as a juvenile."
Last week, a Georgia grand jury indicted Biermann on seven felony charges. These include aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. He was initially arrested on August 19 for aggravated sodomy and aggravated sexual battery following an accusation by a female classmate.
According to court documents, the alleged victim claims the assault occurred in a gym changing area on April 23. The documents state that Biermann allegedly attempted to force sexual intercourse on her and engaged in oral and digital penetration after she refused. The accuser reported the incident the following day and underwent a hospital examination. A police report indicated that no evidence of male DNA was found in her mouth or vagina during that examination.
Biermann has been held without bond at Atlanta’s Metro Regional Youth Detention Center. His bond hearing, initially postponed, has been rescheduled for September 11. Sheffield previously expressed concern over the length of time a minor can be held in detention awaiting a bond hearing on such charges.
