Kim Zolciak and Kroy Biermann's 15-year-old son, Kroy Jr. (KJ), remains in custody following his indictment by a Georgia grand jury on seven charges related to a sexual assault allegation. The charges include aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16, and false imprisonment.
KJ has denied all allegations. If released on bond, experts suggest he will likely face stringent conditions, including close monitoring, GPS tracking, and potentially home-based schooling. "I think there’s a likelihood he’ll be released and he will have a lot of conditions of his release," said Lindsay Richards, a sexual assault case expert and former prosecutor, who is not involved in the case. "I think he’ll be on a GPS. He’ll probably be on house arrest, having to do school at home."
Richards also noted the seriousness of the charges, stating that a conviction could result in decades in prison. The fact that KJ has not been released to his parents with electronic monitoring "surprises me for this young of a kid," she added.
According to court documents, the alleged incident occurred on April 23 in a co-ed sauna at a gym. The accuser alleged that KJ touched her inappropriately, forced her to perform oral sex, and attempted sexual intercourse. KJ's attorney, Jason Sheffield, has stated his client is "100% innocent" and provided evidence including a passed polygraph test. He also argued that KJ is not a flight risk, citing his academic and athletic record, and that he submitted to polygraph testing.
Zolciak has publicly maintained her son's innocence, calling the allegations "reckless and deeply troubling." She stated that KJ passed a polygraph examination and that no DNA belonging to her son was found on the accuser.
KJ was arrested in Alpharetta, Georgia, last month. His legal team has requested that court proceedings remain confidential due to the juvenile status of both parties and the public interest generated by Zolciak's fame as a reality television star.
Zolciak and Biermann, who divorced in 2023 after 12 years of marriage, have had a contentious custody battle over their four minor children. In March, Biermann sought full custody, accusing Zolciak of "blatant mismanagement of basic parenting responsibilities." A judge granted Biermann primary physical custody in June, though they continue to share joint legal custody.
