Kroy Biermann Jr., 15, the son of reality television personality Kim Zolciak, is seeking to have his felony sexual assault case transferred from adult court to juvenile court. Biermann Jr., known as KJ, has been held at the Metro Regional Youth Detention Center in Atlanta since his arrest on August 17. His legal team filed a motion Tuesday requesting the transfer to Georgia's juvenile justice system, which could lead to less severe consequences if convicted.
KJ was indicted by a grand jury on seven felony charges, including aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16, and false imprisonment. These charges stem from an alleged incident with a female classmate at a Life Time fitness center in Alpharetta, Georgia, on April 23.
His attorney, Jason Sheffield, confirmed that the state's indictment is the controlling action in the case, necessitating a change in the judge overseeing the preliminary hearing. Sheffield stated that upcoming court dates include a motion to transfer the case to juvenile court, a bond hearing, and an arraignment. The attorney added that the state intends to try KJ as an adult, a point the defense aims to litigate.
Sheffield explained that holding a 14- or 15-year-old in detention for an extended period awaiting a bond hearing is a consequence of the charges' magnitude. He noted that once charges of this severity are selected, the law governing bond offers little room to consider the juvenile's age or status, effectively removing many protections afforded to minors.
KJ has denied all allegations. His legal team has argued that he is not a flight risk, citing his strong academic and athletic record, including scholarships. They also pointed out that he submitted to polygraph testing and did not flee the state upon learning of the charges in April. The defense is also requesting that the proceedings remain confidential due to the ages of both KJ and the alleged victim, as well as the public interest generated by Zolciak's celebrity status.
An expert in sexual assault cases and a former prosecutor, Lindsay Richards, commented that a release on bond is likely, but would come with strict conditions such as GPS monitoring and house arrest. Richards described the charges as "unbelievably serious," noting that a conviction could lead to decades in prison. She expressed surprise that KJ remained in custody without electronic monitoring, given his age.
According to court documents obtained by the Daily Mail, the alleged victim stated that the incident occurred in a family changing room at the fitness center. She claimed KJ touched her, she refused, and he then allegedly forced her to perform oral sex and attempted further sexual contact. She reported that she managed to get away, and he left the scene.
Zolciak has called the allegations "reckless and deeply troubling" and stated that her son denies any involvement. She claimed KJ voluntarily took and passed a polygraph examination, and that examinations found no DNA belonging to her son. Zolciak expressed confidence that the facts would establish the truth and asked for the legal process to unfold without the spread of unproven allegations.
Police responded to a reported sexual assault on April 24, 2026, after the alleged victim and her father claimed the incident happened the previous day at a nearby gym. An examination at North Fulton Hospital found no evidence of male DNA. Police began attempting to contact KJ's father, Kroy Biermann Sr., in May, who indicated he would discuss the matter with Zolciak. KJ is currently being held without bond in the Juvenile Court of Fulton County. His bond hearing is scheduled for September 11, after being previously canceled. An arraignment on the current indictment is set for October 14.
