Jack Smith Faces Republican Accusations of 'Corrupt' Probe at Senate Hearing
GOP senators claim former special counsel illegally targeted Trump and lawmakers, while Democrats defend his actions.
Former special counsel Jack Smith confronted Republican accusations of a "corrupt operation" that "undermined the rule of law" during a Senate Judiciary Committee hearing on Tuesday. Committee Chairman Chuck Grassley (R-Iowa) asserted that Smith's investigation "broke the rules, lied to the court, and engaged in bad faith," rendering its outcome lacking credibility.
Smith was appointed special counsel in November 2022 by then-Attorney General Merrick Garland to oversee two cases against former President Donald Trump: one concerning the handling of classified documents at Mar-a-Lago and another related to efforts to overturn the 2020 election.
Grassley specifically criticized Smith's team for allegedly leaving a classified facility open, creating a security violation while prosecuting Trump for a similar offense. "Mr. Smith prosecuted Trump for allegedly mishandling classified information," Grassley stated.
However, Smith defended his tenure, affirming in his opening statement, "I stand by my decisions as Special Counsel, including my decision to bring charges against President Trump." He emphasized that his decisions were made "without regard to President Trump's political association, activities, beliefs, or candidacy in the 2024 presidential election." Smith asserted that his investigation developed proof beyond a reasonable doubt of "serious crimes against our nation" and stated he would prosecute a former president on the same facts regardless of political affiliation.
Smith's team brought a total of 41 felony counts against Trump. The Mar-a-Lago case was later dismissed by a Florida federal judge who ruled Smith's appointment was illegal, and the 2020 election case concluded after Trump returned to office in 2024.
Democrats on the committee, led by ranking member Dick Durbin (D-Ill.), supported Smith. Durbin referenced the January 6, 2021, Capitol riot, stating, "Thankfully, Mr. Smith, who is here today and will be under oath, and his team of nonpartisan career prosecutors had the necessary experience to tackle this assignment." He characterized the criticisms against Smith as "petty, personal and political" and "nothing but a smokescreen."
