Harvey Weinstein was sentenced to 15 years in prison on Wednesday for a 2006 felony sex crime in New York, marking another development in the #MeToo movement.
The sentencing for sexually assaulting former TV production assistant Miriam Haley follows a legal process that began with Weinstein's 2020 conviction, which was later overturned. A jury found Weinstein guilty again at a retrial last year.
Weinstein, once a powerful figure in the entertainment industry, faced up to 25 years for the assault at his Manhattan apartment. He has already served over six years as his case has progressed through the legal system.
Haley described the lasting impact of the assault, stating in court that it had a "devastating effect on my life and sense of security that may never go away." She added that speaking up meant she would be "looking over my shoulder for years to come."
Weinstein, 74, apologized in court for any pain he caused but maintained his innocence. "I do have remorse for Miriam Haley’s pain, but I have to reiterate my innocence," he told the judge.
Legal Reversals and Retrials
Weinstein was initially sentenced to 23 years after a jury convicted him of assaulting Haley and raping another woman in 2013. However, New York's highest court erased those verdicts in 2024, citing prejudice from testimony by other accusers whose allegations were not part of the case.
In a subsequent trial last year, Weinstein was reconvicted of a first-degree criminal sex act for assaulting Haley. The jury delivered a split verdict, acquitting him on other charges and being unable to reach a decision on a rape charge involving a different accuser.
Prosecutors later dropped the rape charge involving that accuser after she indicated she could not bear to testify again, paving the way for the current sentencing.
Health and Sentencing Arguments
Prosecutors had sought a 20-year prison sentence. The defense argued for a sentence of three additional years, emphasizing Weinstein's declining health, including blood cancer, congestive heart failure, and kidney issues. His legal team stated that a longer sentence would likely mean he dies in prison.
Weinstein has denied all allegations of rape and sexual assault. He is also awaiting resentencing in a separate rape case in Los Angeles, where his 2022 conviction was upheld but his original sentence was modified.
Weinstein has experienced numerous health issues in recent years, including a COVID-19 diagnosis and emergency surgery. He is currently housed in a medical unit at Bellevue Hospital in Manhattan.
Haley, who met Weinstein through industry connections and briefly worked as a production assistant on one of his shows, testified that he lunged at her in his apartment after they discussed her upcoming travel. She recounted rebuffing his advances, but said he sexually assaulted her, ignoring her pleas to stop.
