Harvey Weinstein Faces New Sentencing for Sexual Assault After Lengthy Legal Battles

Harvey Weinstein is scheduled to be sentenced on Wednesday for one of the same crimes for which he was previously convicted, more than six years after his initial sentencing in March 2020. The 74-year-old faces a potential prison term of up to 25 years for sexually assaulting Miriam Haley, a former TV production assistant, at his Manhattan apartment in 2006. Weinstein has already served more than six years as his case has navigated the criminal justice system through multiple proceedings.

Weinstein, the Oscar-winning producer of films like "Pulp Fiction" and "Shakespeare in Love," was originally sentenced to 23 years after a jury found him guilty of assaulting Haley and raping an aspiring actress, Jessica Mann, in 2013. However, New York's highest court overturned these convictions in 2024, citing prejudice from testimony by other women whose allegations were not part of the original case.

A subsequent retrial last year resulted in Weinstein being convicted again of first-degree criminal sex act for the assault on Haley. Jurors acquitted him of forcibly performing oral sex on another woman, Kaja Sokola, and could not reach a verdict on a rape charge involving Mann. Following a mistrial in May, Manhattan prosecutors dismissed the rape charge related to Mann rather than pursue a fourth trial, as Mann stated she could no longer testify.

Manhattan prosecutors have indicated they will seek a 20-year prison sentence. Weinstein's legal team has not stated what sentence they will request. Weinstein maintains his innocence, denying that he raped or sexually assaulted anyone. He retains the right to appeal his sentence once it is imposed.

Haley, who also goes by Mimi Haleyi, is expected to speak at the sentencing hearing, according to her lawyer, Gloria Allred. Weinstein's spokesperson confirmed that Weinstein also plans to address the court.

Separately, Weinstein is awaiting resentencing in a Los Angeles rape case. A California appeals court upheld his 2022 conviction but vacated his original 16-year sentence due to the judge's consideration of his now-overturned New York convictions as an aggravating factor.

Weinstein's health has been a recurring issue. He has been housed at a medical unit for jail inmates at Bellevue Hospital in Manhattan. His reported health problems in recent years include chronic myeloid leukemia, diabetes, and mobility issues requiring a wheelchair. He underwent emergency surgery two years ago for fluid buildup in his heart and lungs. Early in the COVID-19 pandemic, he tested positive for the virus.

Haley, 49, described meeting Weinstein through a mutual acquaintance and working briefly as a production assistant on "Project Runway," a reality competition show he produced. She testified that she accepted an invitation to Weinstein's apartment before a film premiere, but that he then lunged at her, ignored her protests, and sexually assaulted her. She recounted Weinstein asking after the encounter if they were "we're much closer now," and later telling him, "You know you can't keep doing this."
