Halle Berry's Restraining Order Extended Amid Custody Battle
The court battle between Halle Berry and Olivier Martinez over their son Maceo entered its fifth day with a temporary restraining order extended.
Olivier Martinez’s temporary restraining order against Halle Berry has been extended through the weekend as their custody dispute over their son Maceo continues to play out in court. The Oscar-winning actress and the French actor returned to Stanley Mosk Courthouse in Los Angeles for the fifth day of hearings on Friday.
The proceedings centered on allegations that Berry abused their 13-year-old son. Martinez, 60, continued his closed-door testimony from Thursday, reiterating his claims that Berry engaged in abusive behavior. This comes despite his earlier sworn statement from 2024 that indicated no history of domestic violence between the couple.
Following a lunch break, Berry’s fiancé, Van Hunt, 56, took the stand for his testimony, which also occurred behind closed doors. Hunt appeared relieved as he left the courtroom alone around 4 p.m., though he was later observed laughing with a member of Berry’s legal team.
After court adjourned at 4:30 p.m., both Martinez and Berry, along with their respective legal teams, exited the courthouse. Berry was seen interacting with Hunt in the hallway before departing.
Berry’s daughter, Nahla Aubry, 18, is expected to testify virtually on Monday when the hearing resumes.
On Thursday, Berry’s attorney, Marina Beck, questioned Martinez during cross-examination. She presented him with a declaration he signed in September 2024, stating there was no history of domestic violence between him and Berry. Martinez confirmed his signature and affirmed the statement was true at the time it was made.
Patrick Baghdaserians, Martinez's lawyer, clarified that the 2024 declaration pertained to a financial request and was accurate because no domestic violence conviction or restraining order had been sought at that time. He stated the declaration was for need-based attorneys' fees, not custody matters.
Earlier on Thursday, Berry testified in closed court regarding Maceo. The 13-year-old son himself testified for nearly four hours earlier in the week. The court appearances stem from Martinez’s allegation that Berry choked their son during a confrontation at her home on September 26. Martinez claims this incident is part of a pattern of abusive behavior and that Maceo asked him to pick him up afterward.
A judge had previously granted Martinez a temporary domestic violence restraining order and awarded him primary physical custody of Maceo, limiting Berry's time with their son during the ongoing case. Beck has characterized Martinez's claims as "entirely meritless and deliberately misleading" and stated that Berry denies the allegations.
Berry’s daughter, Nahla Aubry, previously submitted a court declaration stating she had never witnessed her mother abuse Maceo. Berry’s legal team has accused Martinez of interfering with Maceo’s education and therapy and involving their son in their dispute.
Berry is seeking sole legal custody to oversee Maceo's education, therapy, and medical care, and has requested the dismissal of the restraining order. She also seeks to reinstate the previously established 50/50 physical custody arrangement.
Martinez and Berry married in 2013 and welcomed Maceo later that year. They separated in 2015, and their divorce and custody dispute were reportedly settled in 2023, with Berry ordered to pay $8,000 per month in child support.
