Halle Berry's Ex Olivier Martinez Denies Storming Out of Court
Martinez's attorney states the actor took a bathroom break during a custody hearing in Los Angeles.
Olivier Martinez, the ex-husband of Halle Berry, has denied claims that he stormed out of a Los Angeles courtroom on Tuesday during a custody hearing. His attorney, Patrick Baghdaserians, told TMZ that Martinez had requested a three-minute break to use the restroom, which the judge granted.
The statement from Martinez's legal team comes after reports suggested he appeared agitated and distressed, possibly using profanity in an animated discussion with his lawyer before leaving the courtroom.
Earlier this month, Martinez obtained a temporary domestic violence restraining order against Berry. He accused her of physically abusing their 13-year-old son, Maceo, by jumping on him and choking him in a September 26 incident, allegations that Berry has denied.
Martinez's attorney stated that his client was pleased with the court's progress in the case, which has included testimony from Maceo and a school administrator. The court proceedings have been closed during Maceo's testimony.
In legal filings reviewed by The Daily Mail, Berry alleged that Martinez has repeatedly interfered with Maceo's schooling and therapy, hindering progress. She claims Martinez has inappropriately involved their son in the custody battle and undermined her efforts with the teen.
Berry is seeking sole legal custody for matters concerning Maceo's education, healthcare, and mental-health treatment, requesting extended tie-breaking authority. Her legal team stated that Martinez's actions have aimed to obstruct necessary interventions for Maceo and circumvent court orders, citing previous judicial findings and sanctions against him.
According to Berry's filing, Maceo's behavioral issues at school have escalated significantly since the temporary restraining order was issued. School officials noted that Maceo has become increasingly oppositional, defiant, and disrespectful, leading to disruptions, harassment of a younger student, and disciplinary actions including a week of detention. Berry stated that Maceo, with Martinez's encouragement, believes he has a say in decisions regarding his education, health, extracurricular activities, and general welfare.
Berry has also requested that both parents communicate exclusively via the co-parenting app Our Family Wizard, with a limit of one message per day for non-emergency situations. She further requested that Maceo attend a year of therapy sessions, both individual and conjoint, with a therapist of her choosing.
Both Berry and Martinez testified on Wednesday. Berry's boyfriend, Van Hunt, and her daughter from a previous relationship, Nahla Aubry, were also scheduled to testify.
Mason and Berry were married from 2013 to 2015, finalizing their divorce in 2023.
