Halle Berry's Ex Olivier Martinez Awarded Primary Custody of Son
A judge rules French actor Olivier Martinez will have primary physical custody of the couple's 13-year-old son, Maceo, and limits Halle Berry's overnight visits.
Halle Berry's ex-husband, Olivier Martinez, has been granted primary physical custody of their 13-year-old son, Maceo, in a significant development in their ongoing custody dispute. A judge also ruled that Berry will no longer have overnight visits with Maceo.
Berry retains joint legal custody and holds the tiebreaker vote in future disagreements between the parents. A representative for the actress stated that Berry remains focused on her family's well-being.
Martinez's request for a domestic violence restraining order against Berry was denied by the judge. "We are extremely pleased that the Court has dissolved the TRO," stated Marina Beck, Berry's attorney, in a comment to Page Six. "As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family."
Earlier in October, Martinez had obtained a temporary restraining order against Berry, alleging in court filings that she had "physically abusing" Maceo on September 26 by "jumping on him and choking him." Berry has denied these allegations.
During a recent court hearing in Los Angeles Superior Court, Martinez's attorney sought to reopen evidence to question Berry about an Instagram post she shared. The attorney accused Berry of violating the temporary restraining order with the post, which reportedly featured a quote suggesting children disrespecting their mother could be linked to their relationship with their father.
Berry's attorney countered that the attempt to question Berry was a "last-minute grasp at straws" and a "witch hunt," intended to "re-open evidence and continue their false narrative." The judge ultimately denied the request to reopen evidence.
In previous court filings, Berry claimed Martinez has interfered with Maceo's schooling and therapy, hindering progress and involving the child in the custody battle. She had requested sole legal custody for matters concerning Maceo's education, healthcare, and mental health, seeking to extend her tie-breaking authority to prevent further conflict and harm to the child.
