Halle Berry's Attorney Denies Ex Olivier Martinez's Child Abuse Allegations

Halle Berry's attorney has called claims made by her ex-husband, Olivier Martinez, that the actress physically abused their son "meritless" and "deliberately misleading."

Martinez was granted a temporary restraining order on Thursday and is seeking sole custody of their 12-year-old son, Maceo. He alleges that Berry physically and emotionally abused the boy. According to documents obtained by TMZ and People magazine, Martinez claims Berry "physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him."

Martinez also stated in the petition that the September 26 incident, in which he alleges Berry choked their son, is the latest in a series of abuses over the past few years, including additional physical attacks and verbal and emotional abuse directed at both him and their son.

Marina Beck, Berry's attorney, responded, stating, "There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry's minor son Maceo — misconduct for which Mr. Martinez has already been legally sanctioned."

Beck added, "In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs."

Under the terms of the temporary restraining order, Berry must remain 100 yards away from Martinez. She is permitted to see Maceo only during court-ordered visitations twice a week and every other weekend until an Oct. 16 hearing. The former couple has also been ordered to attend confidential mediation regarding custody.

Mazeo reportedly told his father that Berry allegedly entered his room, commented on him wearing virtual reality goggles, and then attacked him, shouting, "Who is dominant now?!"

The petition also requests that Berry not be under the influence and undergo sobriety testing before, during, and after any visits with their son. Representatives for Martinez did not immediately respond to requests for comment.

The former couple finalized their divorce in 2023, eight years after their initial separation. In the settlement, Berry agreed to pay nearly $8,000 in monthly child support for Maceo, along with 4.3% of any income exceeding $2 million. She is also responsible for their son's private school tuition, extracurricular activities, and healthcare.

Martinez is required by the divorce judgment to take "reasonable action" in finding employment and contributing to Maceo's support.

This restraining order petition follows a 2024 filing in which Berry sought sole custody of Maceo, citing Martinez’s alleged "turbulent and detrimental behavior" towards interventions for their son's educational and therapeutic needs, which she claimed impacted Maceo's relationship with her.

Berry also has an 18-year-old daughter, Nahla Ariela Aubry, from a previous relationship with Gabriel Aubry.
