Kenneth Paul Smoglian, 39, a personal trainer and owner of Island Fitness on Kangaroo Island, appeared in Adelaide Magistrates Court last week facing charges of assault, indecent assault, and engaging in sexual intercourse without consent. Smoglian, who also goes by the online moniker "Smogdog," is accused of assaulting a woman over two days in American River, a coastal village on the island.

Police allege that on June 12, Smoglian indecently assaulted the woman by touching her buttocks. The following day, June 13, he is accused of assaulting and raping the same individual. Court documents state that Smoglian allegedly "had sexual intercourse without [her] consent, knowing that she was not consenting... or being recklessly indifferent as to whether she consented."

Smoglian, who has yet to enter a plea, sought bail to reside at his Kangaroo Island home. However, his request was complicated by the Department for Correctional Services' inability to monitor home detention on the island. His legal team highlighted that Smoglian is not originally from South Australia, lacks family support on the mainland, and that his business is facing financial decline while he is in custody.

Prosecutors opposed bail, citing significant concerns that Smoglian might encounter the alleged victim. During the hearing, Smoglian interjected to state his willingness to stay away from the victim's location if deemed eligible for bail, but Chief Judge Mary-Louise Hribal cautioned him to speak through his lawyer and ordered a bail inquiry report.

Smoglian moved to Kangaroo Island after a divorce, having previously run a cocktail bar in Melbourne and worked as a personal trainer. He reportedly sold his Melbourne bar in 2018, citing the business's toll on his personal life and marriage, and sought a fresh start on the island. He also had a prior career as a boxer and was acquainted with Australian boxing champion Andrew Moloney.

Before establishing Island Fitness on Kangaroo Island around 2021, Smoglian lived in Adelaide for a period, working at The Moseley Bar and Kitchen. He had originally considered opening another bar on Kangaroo Island before opting to purchase and transform a business into a gym.
