Federal Agents Raid Home of Rep. Ilhan Omar Amid Immigration Investigation
The investigation, reportedly aiming to denaturalize and deport the congresswoman, has drawn criticism from Omar's office and former President Obama.
Federal agents from Homeland Security Investigations, an arm of U.S. Immigration and Customs Enforcement, recently raided the Washington, D.C. residence of Rep. Ilhan Omar (D-MN). According to The Wall Street Journal, the raid was part of an investigation into her immigration paperwork with the stated goal of denaturalizing and deporting her.
This action marks an escalation in President Donald Trump's years-long criticism of Omar, a progressive lawmaker who arrived in the U.S. as a child refugee from Somalia. Trump has previously called for Omar to be investigated, arrested, and deported. The timing of the raid, close to an election, is unusual for Justice Department actions in political cases.
Reporters familiar with the investigation indicate that agents were examining Omar's birth date and whether she or her father may have provided inaccurate information on her naturalization application. Another focus of the inquiry reportedly involves her father's military service and her childhood in Somalia, including her time fleeing to a refugee camp in Kenya before coming to the U.S. as a refugee.
Washington Post immigration reporter Ted Hesson suggested the investigation feels "pretextual," noting that "it’s almost as if the outcome of the investigation has been stated before anything has taken off." Hesson explained that discrepancies in birth records are common for refugees fleeing countries experiencing civil unrest, where accurate documentation is often unavailable.
While the exact nature of potential charges remains unclear, the investigation's focus on her birthdate raises questions about her age at the time of her application. However, legal experts suggest that even if a discrepancy were found, it would be a complex and lengthy legal process to denaturalize someone based solely on such a paperwork issue.
This case enters new territory by examining the citizenship of a naturalized individual who has been a U.S. citizen for decades. Critics argue that the administration's ability to revisit the files of a sitting lawmaker could set a precedent for targeting other citizens.
In an effort to circumvent potential legal charges, the administration has reportedly explored canceling Omar's citizenship certificate. While this action would not revoke her citizenship, it would invalidate the primary proof of it, potentially leading to complications with federal documents and opening the door for immigration proceedings.
Omar's office has strongly refuted the allegations, stating that the search warrant's guidelines were not followed. They assert that the House Counsel for the Representatives should have been consulted before the search occurred, which would have allowed Omar time to prepare or seek legal recourse. Her office characterizes the investigation as a politically motivated continuation of Trump's attacks.
Former President Barack Obama publicly supported Omar, calling the investigation "appalling" in a social media post. His intervention, which is rare on such matters, is seen as significant, drawing parallels to the birtherism conspiracy theories that targeted him during his presidency. Trump has publicly stated that the Justice Department is acting independently, despite his consistent and vocal criticism of Omar. He has, however, repeatedly encouraged investigations into her background.
