A farmer in Derbyshire, England, who was arrested on suspicion of murder and attempted murder, has been released with no further action following the death of a 19-year-old during a burglary. Marcus Smith died from a gunshot wound early on May 1, 2024, at the scene in Eccles Road, Whaley Bridge.
The Crown Prosecution Service (CPS) stated that the homeowner, in his 50s, discharged a legally held firearm when confronted by burglars. Police submitted a file of evidence to the CPS, which concluded that no charges would be brought in relation to Smith's death. The homeowner has since been released from bail.
A second 19-year-old, who sustained gunshot wounds on the same night, was discovered nearby and received hospital treatment. The CPS indicated that three other men would face legal proceedings in connection with the burglary and a separate break-in at the same property the previous night.
