Ex-NFL Player Marcellus Wiley Accused of Rape in Lawsuit
A new lawsuit filed in Los Angeles alleges former Buffalo Bills player Marcellus Wiley sexually assaulted a USC student in 1999.
Former NFL player Marcellus Wiley is facing a new lawsuit accusing him of "viciously" raping a woman in 1999, according to court documents obtained by the California Post.
The lawsuit, filed in Los Angeles County on Tuesday by a woman using the pseudonym "Jane Doe," alleges that Wiley, then a member of the Buffalo Bills, sexually assaulted her nearly 28 years ago. Doe, who was a 22-year-old USC student at the time, claims she first met Wiley in February 1999 and went on two dates.
According to the lawsuit, Doe informed Wiley that she was not sexually active, lacked sexual experience, and was not interested in a romantic relationship. Weeks later, Wiley invited Doe to a nightclub in downtown Los Angeles. After their night out, Wiley allegedly asked Doe to return to his hotel, the Hilton near LAX Airport.
Doe agreed to accompany Wiley to his hotel due to the late hour and lack of access to her car. The lawsuit states that in the hotel lobby, Wiley repeatedly pressured Doe to spend the night in his room. Doe claims she explicitly told Wiley she was not interested in sex and intended to sleep immediately, and that Wiley stated he understood and agreed.
Doe alleges that she fell asleep in the hotel room fully clothed. However, she claims that later that night, Wiley sexually assaulted her. The lawsuit states Doe told Wiley to stop multiple times, saying, "You're not listening to me."
According to the suit, Wiley did not stop the assault. Doe alleges that Wiley commented, "Look at you… keep shaking." After the alleged assault, Wiley reportedly drove Doe back to her dorm and informed her he had "the clap" and she should get tested for sexually transmitted diseases. Doe claims they never spoke again.
Doe stated that a subsequent rape kit tested positive for bruising and Wiley's semen. She also reported filing a police report, but in April 1999, the District Attorney declined to file charges, citing Wiley's denial of the allegations.
The lawsuit accuses Wiley of sexual battery, assault, battery, and intentional infliction of emotional distress. Doe's attorney, Noah Werksman, said in a statement, "This lawsuit marks the first step toward holding Marcellus Wiley accountable for his horrific abuse of our client. We look forward to standing beside her as she tells her story in court."
Wiley has previously denied allegations of sexual assault made by his estranged wife in an application for a domestic violence restraining order. He also faces previous accusations of sexual misconduct from multiple women in New York, which he has also denied.
Marcellus Wiley, now 51, played in the NFL from 1997 to 2006 for the Buffalo Bills, Jacksonville Jaguars, and San Francisco 49ers.
