Prosecutors presented new surveillance footage in a Utah courtroom Friday that they allege shows Tyler Robinson, the accused gunman, stalking conservative activist Charlie Kirk before the September 2025 shooting on the Utah Valley University campus. Benny Johnson, a commentator and friend of Kirk, described the evidence as an "evidentiary bombshell" during an appearance on "Fox News @ Night."
The case is currently in the preliminary hearing phase, where prosecutors must demonstrate sufficient probable cause to proceed to trial against the 23-year-old Robinson, who has not yet entered a formal plea. The state's evidence includes witness testimony, surveillance footage, alleged messages between Robinson and his roommate, and recorded video statements from the roommate.
Johnson stated that high-definition footage shown in court depicted Robinson on campus for four separate visits, scaling a rooftop, and entering a "sniper-prone position" minutes before the shooting. He reported that the courtroom audience gasped upon viewing the extended footage, which was specifically shown to Kirk's family.
"My question to anybody doubting at this point if Tyler Robinson killed Charlie Kirk is, 'What more do you need?'" Johnson said, emphasizing the need for a swift resolution for the grieving Kirk family. He added that the nation's constitutional right to a speedy trial should extend to the family, who he said have faced "enormous amount of harassment and attacks."
The defense team, led by attorney Michael Burt, attempted to challenge the presented evidence, with Burt accusing the prosecution of wasting the court's time. The judge has requested both sides submit written briefs on the probable cause issue, with oral arguments scheduled to resume in September.
