DNC Sues Trump Administration Over Alleged Illegal Use of $20 Million in Federal Funds for Political Ads

The Democratic National Committee (DNC) has filed a lawsuit against the Trump administration, alleging the illegal diversion of $20 million in federal funds for the creation and distribution of partisan political advertisements. The lawsuit contends that these ads were designed to bolster Republican prospects in the upcoming 2026 midterm elections and improve President Donald Trump's approval ratings.

The DNC argues that this use of funds constitutes an unlawful application for "publicity or propaganda purposes," a practice prohibited by statute. The lawsuit specifically claims that President Trump personally directed the campaign, violating a long-standing ban on using federal appropriations for such activities.

According to the court filings, the Office of Management and Budget (OMB) reallocated funds authorized under the One Big Beautiful Bill Act. The OMB reportedly transferred these funds from a U.S. Customs and Border Protection line item designated for "Commemorative Events." The lawsuit notes that congressional committee reports explicitly restricted this particular fund to cover only line-of-duty death memorials, agency anniversaries, and commendation ceremonies.

The lawsuit points to mounting political pressure on Republicans, citing declining poll numbers in key battleground and traditionally conservative states, suggesting Democrats are positioned to gain control of Congress, governorships, and state legislatures.

Among the advertisements highlighted in the filing is one featuring President Trump discussing the capture of former Venezuelan President Nicolás Maduro. Another ad reportedly shows Trump addressing the audience directly, stating, "With you at my side, we will demolish the Deep State. We will expel the warmongers from our government. We will drive out the globalists; we will cast out the communists, Marxists, and fascists."

A third ad is cited as explicitly urging viewers to "pretend I'm on the ballot" to encourage voter turnout. The lawsuit also names high-ranking administration officials, including War Secretary Pete Hegseth and Secretary of State Marco Rubio, for their appearances in the ads praising Trump.

DNC Chair Ken Martin stated in a release that "Donald Trump is misusing millions of taxpayer dollars to fund pure propaganda ads in a last-ditch attempt to save Republicans in November — so we’re suing him." Martin further criticized the diversion of funds from a pool intended for memorials of Americans killed in the line of duty to promote the president's policies, especially as costs for gas and groceries increase and his approval ratings decline.

The lawsuit seeks a court declaration that the Trump administration and relevant federal agencies unlawfully produced and broadcast these advertisements using congressionally appropriated funds. It also requests an immediate injunction to halt any further use of taxpayer dollars for the campaign.
