Cyclist Sentenced for Manslaughter After Fatal Confrontation
A man has been jailed for over six years for killing a pensioner who admonished him for riding on a pavement.
A cyclist has been sentenced to six years and eight months in prison for the manslaughter of a 79-year-old pensioner. Thomas Childe, 24, deliberately rammed his bicycle into Colin Starbuck on October 29 last year in Garforth, West Yorkshire, after being told off for riding on the pavement without lights.
Childe, described as a chronic cannabis user, was on his way to withdraw cash to purchase drugs when the incident occurred. He became annoyed after Mr. Starbuck rebuked him for his cycling behavior. A judge stated that Childe made a "deliberate decision to pick on an old man."
Witnesses reported that Mr. Starbuck was waiting at a bus stop when Childe rode past him on the pavement. After Mr. Starbuck's rebuke and Childe's angry response, Childe later returned and intentionally rode into the pensioner. Mr. Starbuck was knocked to the ground and, after briefly restraining Childe, was thrown into the road, striking his head. He suffered a cardiac arrest and was pronounced dead at the hospital. A pathologist determined that the cardiac arrest was attributable to the attack, exacerbated by an underlying heart condition.
Childe was arrested but initially refused to answer police questions. He was charged with murder but later pleaded guilty to manslaughter at Leeds Crown Court. During sentencing, Judge Tom Bayliss KC told Childe that he was sure the cyclist intended to cause harm and to intimidate Mr. Starbuck.
"You thought it was not his place to tell you what to do. You made a deliberate decision to pick on an old man," the judge remarked, noting Childe had shown no remorse.
Relatives of Mr. Starbuck described their family as "distraught and distressed by the loss" in a statement read to the court. Detective Superintendent Matt Holdsworth of West Yorkshire Police commented that the investigation proved Childe was responsible for the "needless death" and expressed hope that the outcome would provide some comfort to Mr. Starbuck's family.
