Tori McMechan, 55, is refusing to leave her Nunn, Colorado, home, which is currently listed for sale as 'being sold occupied' and has been under threat of foreclosure for 15 years. McMechan stated she is prepared to fight any attempts to remove her from the property.
The home at 408 Garfield Avenue was purchased by McMechan's late husband in 2006. She claims that following his death, the bank prevented her from making mortgage payments under his name. "The bank has been unwilling to work with me as a surviving spouse," McMechan told Arizona Family. She added that the mortgage would have been fully paid off by 2021.
McMechan has pursued legal avenues, filing numerous appeals over the years with the help of three attorneys. The case culminated this year when the Court of Appeals ruled against her, allowing the property to be listed for sale.
The listing by Kittle Real Estate describes the three-bedroom, two-bathroom house, valued at $215,280, as "being sold occupied." However, the real estate agency admits that agents have been unable to access the home and cannot provide interior photographs. The listing states that buyers "assumes the property in its current, unknown, as-is condition with the occupants in place" and will be responsible for obtaining possession.
"The ad is unreal, right? Who would buy a home sight unseen, with the occupant still in it?" McMechan questioned. She indicated that future buyers would find it "pretty difficult" to remove her, stating, "I'm not leaving willingly." She also emphasized the emotional significance of the home, stating, "This was the last thing that my husband bought for me before he passed. This is where I raised my children."
According to McMechan, her husband died in a car crash amid a local dispute. She believes a recent law enacted in 2024, concerning evictions, may offer her a path to a jury trial to determine the lawfulness of any eviction proceedings.
The property is located in Nunn, a small rural town in northern Colorado with a population of 504, according to the 2020 U.S. Census. The house is situated in a remote area accessible by dirt roads.
