Charlie Kirk's parents and widow, Erika, are set to attend a five-day preliminary hearing in Utah this week, where prosecutors will present distressing new evidence against Tyler Robinson, the 23-year-old accused of his murder. This marks the first time Kirk's family will be in the same courtroom as Robinson, who has been charged with aggravated murder.
Prosecutors are seeking the death penalty for Robinson, who surrendered to authorities after Kirk was shot and killed on September 10, 2025, while speaking to thousands at a Turning Point USA event at Utah Valley University. Authorities allege Robinson sent a text message confession to his partner following the shooting. He has not yet entered a plea, and his attorneys have not commented on his guilt or innocence.
Hearing Details and Evidence
The hearing, which began today, will function as a mini-trial, with prosecutors planning to introduce DNA evidence linking Robinson to the suspected murder weapon, investigator testimony, autopsy findings, witness statements, and video footage of Kirk's killing. While prosecutors need only demonstrate reasonable grounds to believe Robinson killed Kirk, the standard for a trial is higher, requiring proof beyond a reasonable doubt. State District Judge Tony Graf will ultimately decide if the case proceeds to trial.
Robinson's partner, Lance Twiggs, reportedly received a note from Robinson stating, "I had the opportunity to take out Charlie Kirk and I´m going to take it." Text messages allegedly from Robinson to Twiggs also said, "I had enough of his hatred. Some hate can't be negotiated out."
Courtroom Access and Legal Proceedings
Erika Kirk, who took over leadership of Turning Point USA after her husband's death, advocated for public access to the proceedings. Judge Graf has allowed news cameras in the courtroom, stating that electronic media coverage facilitates public access to court proceedings. However, journalists and the public will be restricted from bringing laptops and phones into the courtroom due to concerns about compromising the integrity of the hearing.
In a prior ruling on June 26, Judge Graf held Utah County Prosecutor Christopher Ballard in civil contempt for conducting a "media tour" discussing ballistic evidence in the case. Despite this, the judge denied a defense request to remove the death penalty from consideration.
Background of the Accused
Robinson, 23, was described as a promising student from a conservative Utah family who maintained a 4.0 GPA. Friends and family report a change in his demeanor around the time of the COVID-19 pandemic, which investigators believe may be linked to online radicalization. He has not entered a plea in the case.
Charlie Kirk's family, including his parents Robert and Kathryn Kirk and his sister Mary, released a statement ahead of the hearing, calling the proceedings a "painful reminder of his death" and asking for privacy. Erika Kirk and his parents are expected to attend the hearing, though his sister's attendance is uncertain.
