CBS News Sued for $20 Million Over Teen Misidentification in Reflecting Pool Vandalism Report

CBS News is facing a $20 million defamation lawsuit from a 15-year-old Maryland resident who claims he was wrongly depicted as a suspect in the vandalism of the Lincoln Memorial Reflecting Pool. The lawsuit, filed in U.S. District Court in the District of Columbia, asserts that CBS News broadcast and published a report that falsely linked the teenager, identified as "JV," to the crime.

The complaint states that CBS News used footage of JV, who was briefly detained for riding an e-bike in the area, alongside assertions that five individuals had been arrested for vandalizing and "sabotaging" the Reflecting Pool. The lawsuit argues this reporting falsely portrayed JV as one of the perpetrators of a federally publicized crime.

JV was reportedly released without charges, and his detention was unrelated to the vandalism. The lawsuit alleges that CBS News used video of JV in handcuffs while anchor Jericka Duncan stated that arrests had been made. In online and social media versions of the report, JV's face was allegedly shown, leading to him being recognized by friends and acquaintances.

"The accusation was particularly damaging because at all times material to the allegations, the Reflecting Pool renovation and subsequent alleged vandalism of the Reflecting Pool is or has been the subject of intense national attention and political controversy," the lawsuit states. It also notes President Donald Trump's strong condemnation of those accused of vandalism.

The legal filing claims that CBS News either knew its portrayal of JV was false or acted with reckless disregard for the truth. The lawsuit details the profound consequences JV has allegedly faced, including embarrassment, humiliation, anxiety, and fear that the false accusation will impact his future academic and career opportunities.

While CBS News issued an on-air correction, the lawsuit contends that this did not undo the harm caused by the initial publication. CBS News declined to comment on the pending litigation.

A judge had previously dismissed the vandalism case against David Hearn, a former Olympian who had been accused of damaging the Reflecting Pool's renovation project.
