Canadian Tourist Found Guilty of Animal Cruelty in Las Vegas Flamingo Theft
Mitchell Fairbarn convicted of felony and misdemeanor animal abuse charges for stealing a flamingo from the Flamingo Las Vegas Hotel and Casino.

A Canadian tourist has been found guilty of animal cruelty after stealing a Chilean flamingo, named Peachy, from its enclosure at the Flamingo Las Vegas Hotel and Casino and taking it to his hotel room. Mitchell Fairbarn was convicted of felony and misdemeanor animal abuse charges by a jury that deliberated for approximately five hours.
Fairbarn, who was visiting Las Vegas in March, testified that he had consumed 30 to 40 beers before the incident and believed it would be humorous to take the bird. He stated that he did not intend to harm the animal. His lawyer, Josh Tomsheck, attributed Fairbarn's actions to alcohol-induced poor judgment, describing him as "drunk" and "stupid."
During the trial, animal experts testified that Peachy suffered torn feathers and blood loss as a result of Fairbarn's actions. A veterinarian stated that while the flamingo has largely recovered physically, it now exhibits a more anxious demeanor around humans.
Fairbarn has been unable to leave the United States since his arrest and is currently under house arrest in Las Vegas. Sentencing is scheduled for December, where he could face up to five years in prison. His lawyer also mentioned that Fairbarn has received death threats following his arrest.
The Flamingo Las Vegas features a wildlife habitat accessible to the public, housing Chilean flamingos and other animals. The trial involved testimony from 14 witnesses and the review of over 112 pieces of evidence.
