California Law Eases Jury Duty Exemptions for Seniors

Beginning in January 2028, Californians who are 80 years of age or older will be able to request a permanent exemption from jury duty if they have a health condition that prevents them from serving. This new provision, established by Assembly Bill 1359, eliminates the requirement for a doctor's note to obtain such an exemption.

Upon receiving a jury summons, individuals who qualify can submit a written statement to the jury commissioner, self-affirming that a health impairment prevents them from participating in jury service. Those over 80 who do not have a health impairment will still be expected to serve if called.

Assemblymember Patrick Ahrens, the bill's author, stated that the legislation was inspired by discussions about the difficulties elderly individuals face in obtaining jury duty exemptions. "Seniors are great jurists that can and will continue to serve if they’re willing and able to," Ahrens told CalMatters. "But if they cannot, they will no longer have to jump through hoops to permanently opt out."

Andrew Mendoza, director of state affairs for the Alzheimer’s Association, noted during a June hearing that the bill could assist individuals with undiagnosed conditions. He explained that many people living with Alzheimer's disease may not have a formal diagnosis or a caregiver to help them navigate the system for exemptions. Mendoza added that the bill could help vulnerable populations avoid a potentially stressful process.

California's new law follows similar provisions in other states. Florida allows residents aged 70 and older to opt out of jury duty, and Texas has a similar exemption for those 75 and older. Currently, Californians aged 70 and older can request to be excused from jury service due to a medical condition without a doctor's note, but these exemptions are not permanent and must be requested each time a summons is received.
