British Father Pleads Guilty in Son's Cyprus Hotel Balcony Death

A British father has pleaded guilty to causing his two-year-old son's death after the toddler fell from a fourth-floor hotel balcony in Cyprus. Joshua Foster, 37, an AI director at KPMG, faces a maximum sentence of four years in prison. His sentencing is scheduled for October 5, after which he will learn his fate.

Foster's lawyer stated that the incident was a "momentary lapse of attention, without any intention to cause harm, which had the most devastating and unimaginable consequences." The tragic event occurred on the first day of the family's holiday at the five-star King Evelthon Hotel near Paphos. Foster had reportedly placed his son on a windowsill while waiting for a lift, believing the window was closed. The child then fell backwards 33 feet and was pronounced dead at Paphos General Hospital.

Foster, who hails from Essex, was arrested hours after the incident on suspicion of causing death by 'a rash, dangerous or reckless act.' He was initially held on remand for eight days. His lawyer argued for the case to be dismissed on humanitarian grounds, citing the profound trauma the family has endured and stating that a prolonged legal process would only deepen their grief.

Opting to plead guilty was a decision made "in order to end this story, to face whatever is going to be the penalty" and to return to his family. His legal counsel intends to present mitigating evidence and circumstances to the court ahead of sentencing. Foster is currently allowed to travel home for ten days before his sentencing.

Toxicology reports indicated a small amount of alcohol in Foster's blood, equivalent to one or two drinks. He was initially required to pay €30,000 (£25,750) in bail and was prohibited from leaving Cyprus, though this restriction was temporarily lifted to allow him to bury his son. He was released on the same bail conditions after entering his guilty plea.

The deceased toddler is described by a family member as a "truly special, easy-going little boy who brought so much joy to everyone around him." Foster, who has worked at KPMG since 2015, also co-founded a tennis competition app called Sportch.

The safety record of the King Evelthon Hotel has drawn attention, as this child is reportedly the third British tourist to die there in four years. Previous incidents include a drowning in the hotel's pool in July 2022 and another drowning the following year. A separate death was also reportedly recorded in 2024. A visit by the Daily Mail found a large fourth-floor window at the hotel still open, raising questions about adherence to safety guidelines. While UK guidelines suggest windows large enough for children to fall through should have restricted openings, Cypriot regulations require only a ledge of at least 3.5 feet, a standard the King Evelthon Hotel meets.
