British Columbia Sues OpenAI Over ChatGPT Use in Fatal Shooting

The Canadian province of British Columbia has filed a lawsuit against OpenAI, alleging the artificial intelligence company failed to alert authorities about concerning user interactions on ChatGPT that preceded a fatal mass shooting in Tumbler Ridge. The lawsuit, filed in a U.S. federal court, raises questions about the responsibilities of technology companies when they become aware of credible threats of serious violence, according to B.C. Attorney General Niki Sharma.

OpenAI had previously apologized for not flagging the account of Jessie Van Rootselaar, who was 18 at the time of the February incident, to law enforcement. Van Rootselaar killed eight people, including six children, in the attack. Families of those affected by the shooting have also filed separate lawsuits against the company.

Media reports indicated that OpenAI's safety team had flagged Van Rootselaar's ChatGPT activity months before the attack due to references to gun violence. However, the company did not notify local authorities. In April, OpenAI CEO Sam Altman issued an open letter apologizing to the victims' families, stating, "I am deeply sorry that we did not alert law enforcement."

Sharma stated that OpenAI has not yet taken "meaningful steps to address the concerns raised by survivors, families and the Tumbler Ridge community." She added that the company still has an opportunity to demonstrate accountability by strengthening safeguards, improving transparency, and taking concrete action to prevent similar tragedies.

According to AFP, the lawsuit was filed in California because the alleged decision not to report the shooter's ChatGPT account occurred in that U.S. state. Sharma indicated that any financial damages awarded to the province would be directed towards rebuilding the secondary school that was the site of the shooting.

Sharma also noted that the province has requested OpenAI disclose the relevant ChatGPT conversations, but the company has refused. "We should all be asking them: Why?" she was quoted as saying by CBC News.
