Australian Law Professor Sues University Over Free Speech Claims

Dr. Joanna Howe, a prominent anti-abortion campaigner and law professor at Adelaide University, is suing her employer, asserting that her academic career is "on the brink" due to what she describes as over 200 complaints related to her public statements. Howe claims the university has breached her contract and the Fair Work Act.

Court documents indicate that a formal investigation into Howe's advocacy began in November of the previous year, following an external complaint. The allegations and sub-allegations have since reportedly surpassed 200, concerning remarks she made on topics including abortion, Islam, and "gender ideology." Howe maintains that these allegations pertain solely to her advocacy and not to her research or teaching duties.

Howe stated that her experience at the Adelaide Law School has become increasingly difficult, reporting that she has not been on campus since February and has been met with unsupportive reactions from colleagues. She described one instance where a colleague "literally screamed in my face."

Despite considering resignation, Howe asserts her rights to academic freedom and free speech are protected by law and federal statutes. She has indicated a willingness to pursue the matter to the High Court if necessary.

Adelaide University's Deputy Vice-Chancellor, Joanne Fox, acknowledged the seriousness of the matter but stated the university had not received any court documents and therefore could not comment.

This legal action follows a dispute in 2024 where Howe appealed to the Fair Work Commission over workplace measures imposed on her, despite previous investigations clearing her. The university ultimately agreed to a commission recommendation that the measures be removed and no further action be taken.

Howe and her husband, James Howe, also drew public attention in September for criticizing consent educator Chanel Contos and the government's funding for her organization. In a social media video, the couple questioned Contos's approach to consent education, with James Howe making controversial statements about consent. Dr. Howe accused Contos of exaggerating the threat of sexual violence and suggesting men were not solely to blame.

The video prompted a statement from Adelaide University Vice-Chancellor Nicola Phillips, who said the university was aware of the commentary but declined to comment on individual staff matters.

Dr. Howe holds a doctorate in law from the University of Oxford and joined Adelaide University as a lecturer in 2012, becoming a full professor in 2023. She and her husband have five children.
