An Arizona court has quashed the sentence of a man convicted in a 2021 road rage killing, ruling that the use of an artificial intelligence-generated video of the victim in court was improper. Gabriel Paul Horcasitas, 55, was found guilty by a jury of shooting and killing Christopher Pelkey, 37, during a confrontation at a red light and was sentenced to 10 years in prison.
Horcasitas' legal team appealed the sentence, contending that the trial judge should not have permitted the AI video to be shown before sentencing. The Arizona Court of Appeals agreed, determining that the video, created by Pelkey's family, crossed a line by presenting a depiction of the victim and his thoughts generated from the imaginings of his sister, rather than documenting an event or recording a specific moment.
The AI video, created by Pelkey's sister, Stacey Wales, used voice recordings, videos, and pictures of the victim to recreate him. In the video presented in court in 2025, the AI version of Pelkey stated, "To Gabriel Horcasitas, the man who shot me, it is a shame we encountered each other that day in those circumstances. In another life, we probably could have been friends." The AI also conveyed a message of forgiveness.
At the time of the original sentencing, the presiding judge, Todd Lang, expressed appreciation for the AI video, noting, "I loved that AI, thank you for that. As angry as you are, as justifiably angry as the family is, I heard the forgiveness. I feel that that was genuine."
Following the appeals court's ruling, Horcasitas will be resentenced. Representatives for Horcasitas' lawyer and the victims' attorney did not immediately respond to requests for comment.
