Social media personalities Andrew and Tristan Tate appeared in federal court in Miami on Monday, facing allegations of rape and abuse as U.S. prosecutors consider their extradition to the United Kingdom. The brothers, who are dual British-U.S. citizens, are being held in federal detention pending a judge's decision on whether they meet the conditions for extradition.
According to unsealed federal court documents, prosecutors in Britain allege that Andrew Tate, 39, choked a woman to the point of unconsciousness before raping her in an alleged 2015 attack. Another woman claims Andrew choked her during a later encounter at her home in Manchester in 2014, after initially meeting him through a dating app and having consensual sex.
Federal court complaints also accuse Tristan Tate, 38, of choking, beating, and raping a woman between 2012 and 2013. This accuser reportedly told authorities that Tristan routinely choked her to unconsciousness and whipped her with a belt on multiple occasions. She had reported him to UK authorities multiple times during their long-term relationship.
British authorities are seeking the extradition of the brothers in relation to an original 21 charges, along with several newly added counts. Andrew Tate faces seven additional counts of rape, three of arranging or facilitating trafficking for sexual exploitation, three of assault occasioning actual bodily harm, and 19 charges related to indecent images of a child and extreme pornography. Tristan Tate is charged with one count of sexual assault, two counts of rape, and three counts of arranging or facilitating trafficking for sexual exploitation.
The brothers, known for their social media presence promoting wealth and misogynistic views, deny all allegations. Their attorney, Joseph McBride, stated after the hearing that they are objecting to extradition, asserting their innocence and claiming the attempt to extradite them is politically motivated.
McBride suggested the arrests were timed after the Tates met with "friends in Washington, DC," implying a political motive. However, the Justice Department told The Associated Press that the arrests were approved by leadership of its Criminal Division.
These allegations are part of a broader legal history involving the Tates, who moved to Romania in 2016 and were arrested there in 2022 on suspicion of participating in schemes to lure women for sexual exploitation. Those Romanian charges have faced legal and procedural challenges, and the brothers were permitted to leave Romania last year.
The current charges in the UK, which span from 2010 to 2017, were brought after authorities received evidence from Bedfordshire Police. The allegations include rape, assault, trafficking, and offenses related to indecent images of children and extreme pornography.
Andrew Tate first gained public attention a decade ago as a contestant on the UK reality show 'Big Brother,' from which he was removed after a video appeared to show him assaulting a woman. He has amassed millions of followers on social media platforms, although he has been banned from others for violating hate speech guidelines. He has previously made controversial statements regarding sexual assault victims and women.
The brothers' lawyer stated that none of the latest accusers have been identified and that they wish to know who is accusing Andrew and Tristan of what.
A U.S. Magistrate Judge Lauren Louis has scheduled another hearing for July 27.
