Rebel Creamery, a Utah-based ice cream brand sold at major retailers including Walmart, Kroger, and Safeway, has filed for Chapter 11 bankruptcy protection. The filing comes as the company appeals a recent federal court ruling that ordered it to pay $23.785 million to Van Leeuwen Ice Cream for intentionally infringing on its packaging trade dress.

According to court documents, Rebel Creamery reported approximately $13.78 million in assets and $23.85 million in liabilities. The bankruptcy filing allows the company to continue operating while it reorganizes and addresses its financial obligations, including the judgment from the lawsuit.

Packaging Infringement Ruling

In a memorandum and order issued on July 16, U.S. District Judge Eric Komitee stated that evidence presented at trial left "no doubt that Rebel infringed and diluted Van Leeuwen's trade dress and did so intentionally." The ruling also mandated that Rebel Creamery redesign its product packaging to prevent consumer confusion with Van Leeuwen's distinct pastel-colored pints featuring black script lettering.

Van Leeuwen had initially sought $36.4 million in damages. The court's final judgment was lower, partly because some consumers purchased Rebel Creamery's products for their keto-friendly attributes rather than solely based on packaging appearance.

Fans of both ice cream brands had previously noted the similarities on social media platforms like Reddit. Comments highlighted that the "font treatment is near identical" and that Rebel's packaging "extremely similar" to Van Leeuwen's distinctive colors and lettering.

Rebel Creamery's Market Position

Rebel Creamery was founded in 2017 with a focus on offering indulgent, full-fat, zero-sugar ice cream options. The company's website promotes its keto diet-friendly products, which are high in fat and low in carbohydrates with no added sugar. Flavors include chocolate caramel nut and banana peanut butter chip.

Van Leeuwen Ice Cream, established over 15 years ago, began as an ice cream truck in New York City. The company introduced its current packaging in 2016, a year before Rebel Creamery was founded. Van Leeuwen has since expanded to multiple retail locations and its pints are available at retailers such as Target, Shoprite, Acme, and Whole Foods.

Despite the bankruptcy filing and ongoing appeal, Rebel Creamery's products remain available for purchase on its website, though current listings indicate shipping delays of three to four weeks.
