Novo Nordisk Sues Eli Lilly Over Weight-Loss Drug Advertising
Novo Nordisk alleges Eli Lilly made misleading claims comparing the efficacy of their respective weight-loss medications.
Novo Nordisk, the manufacturer of popular weight-loss drugs Ozempic and Wegovy, has filed a lawsuit accusing competitor Eli Lilly of false advertising. The Danish pharmaceutical company claims that Eli Lilly, maker of Mounjaro and Zepbound, has run ad campaigns suggesting its own drugs are superior through deceptive comparisons.
The lawsuit, filed in the U.S. on Tuesday, asserts that Eli Lilly's advertising intentionally compared the highest approved doses of its obesity and type-2 diabetes medications with lower doses of Novo Nordisk's drugs. Novo Nordisk alleges that these campaigns omitted newer, higher-dose options available for its own medications. The company stated that these advertisements create a "misleading impression that Eli Lilly's medicines are superior."
According to Novo Nordisk, the specific comparisons in question involved Mounjaro versus Ozempic and Zepbound versus Wegovy. The company contends that Eli Lilly's campaigns utilized outdated studies and "deceptively" presented its products as better while burying or omitting crucial clinical context.
"As new and more effective treatment options become available, people deserve accurate information that reflects the latest scientific evidence and helps them make informed care decisions," said John F. Kuckelman, senior vice president and group general counsel for Novo Nordisk. "Healthcare companies have a responsibility to keep their public claims accurate and current - ineffective, fine-print disclaimers do not fix the misleading impression created by major national campaigns."
Novo Nordisk claims its competitor has committed "multiple violations" of federal and state false advertising and unfair competition laws through its nationwide campaigns.
The company is seeking a court order that would compel Eli Lilly to withdraw its current advertisements and instead run a "corrective advertising campaign." Novo Nordisk also indicated it would file a motion for a preliminary injunction to block the commercials if Eli Lilly does not voluntarily remove them.
This legal action unfolds as both Novo Nordisk and Eli Lilly are engaged in a significant competition to capture a dominant share of the rapidly expanding weight-loss drug market. Analysts estimate this market could exceed $100 billion by 2030, particularly within the United States.
